Tip - Housing Allowance Unconstitutional?
Housing allowances for
ministers are once again under attack. On October 16, 2009 the
Freedom from Religion Foundation, Inc. group filed suit against
Timothy Geithner (Secretary of the U.S. Department of Treasury),
Douglas Shulman (commissioner of the IRS), and Selvi Stanislaus
(Executive Officer of the California Franchise Tax Board). The
FFRF group is seeking to have housing allowance declared as
unconstitutional because it violates the Establishment Clause of
the First Amendment to the Constitution of the United States
because it provides a tax benefit only to ministers and it
advances religion.
